Pemegang Lisensi LOIS Gugat NEWLOIS

Pemegang lisensi merek dagang Lois, PT Intigarmindo Persada mengajukan gugatan pembatalan merek Newlois dan Redlois. Kedua merek tersebut dianggap memiliki persamaan pada pokoknya dengan merek Lois milik Lois Trade Mark-Consultores E Servicos S.A.
 
Lois adalah merek dagang yang digunakan untuk produk celana dan jaket berbahan jeans. Lois Trade Mark-Consultores E Servicos S.A merupakan perusahaan asal Spanyol yang mendaftarkan merek Lois terlebih dahulu di Indonesia, yakni pada 8 November 2004 dengan No. IDM000020831.
 
Merek tersebut masuk dalam daftar merek untuk kelas 25 yang melindungi barang jenis pakaian luar dan pakaian dalam, alas kaki, dan tutup kepala.
 
Sebagai pemegang lisensi Lois di Indonesia, Intigarmindo Persada yang diwakili kuasa hukumnya Harris Priyono Nainggolan merasa berhak mengajukan gugatan.
 
“Sebagai penerima lisensi dan pemegang kuasa dari Lois Trade Mark-Consultores E Servicos S.A, maka penggugat diberikan hak untuk melakukan setiap langkah hukum yang diperlukan atas produk palsu atau tiruan di Indonesia,” tulis Harris seperti dikutip dari berkas gugatannya, Minggu (14/2/2016).
 
Dia mengemukakan, gugatan ini bermula dari ditemukannya produk celana dengan merek Newlois dan Redlois di Toko Gerimis di daerah Tanah Abang, Jakarta Pusat miliki Agus Salim pada 15-18 April 2015.
 
Intigarmindo Persada kemudian membuat laporan kepada Direktorat Jenderal Kekayaan Intelektual (Dirjen KI) untuk menindaklanjuti dugaan tindak pidana merek. Penyidikan terkait dengan saksi, ahli, dan barang bukti pun dilakukan.
 
Dirjen KI kemudian memutuskan untuk menghentikannya dengan alasan tidak ditemukannya tindak pidana merek. Lembaga yang berwenang atas perlindungan merek di Indonesia itu malah menemukan bukti adanya pendaftaran hak cipta milik Agus. Sehingga, merek Newlois dan Redlois mendapat perlindungan hukum.
 
Kedua merek milik Agus itu sudah terdaftar di sejak 28 Juli 2005 dengan nomor pendaftaran IDM000043020 dan IDM000043201. Dalam perkara ini, Intigarmindo Persada turut menyertakan Dirjan KI sebagai turut tergugat.
 
Penggugat menilai pendaftaran merek Newlois dan Redlois itu didaftarkan dengan iktikad tidak baik dengan membonceng, meniru atau menjiplak merek Lois.
 
Apalagi merek Lois milik Lois Trade Mark-Consultores E Servicos S.A diajukan terlebih dahulu, yaitu pada 12 Mei 2003. Sedangkan Agus baru mengajukan permohonan merek pada 28 Juli 2005.
 
Harris menambahkan merek Lois tak hanya terdaftar di Indonesia, namun juga telah terdaftar di berbagai negara seperti, Argentina, Arab Saudi, Chili, Filipina, Hong Kong, Malaysia, dan Taiwan.
 
Dalam petitumnya, Intigarmindo Persada meminta kepada majelis hakim untuk membatalkan merek Newlois dan Redlois milik Agus Salim karena memiliki persamaan pada pokoknya dengan merek Lois milik Lois Trade Mark-Consultores E Servicos S.A.
 
Berdasarkan informasi dari Pengadilan Niaga Jakarta Pusat, perkara ini baru memasuki persidangan perdana pada Selasa 9 Februari 2016. Saat itu baik Agus Salim maupun perwakilannya tak hadir. Majelis menunda persidangan hingga Selasa pekan ini.
