Jam Tangan Asal AS Philip Stein Kalah Lawan `Barang Bajakan`

Produsen jam tangan asal Amerika Serikat, Philip Stein Holding Inc, harus mengakui kekalahannya. Sebab Mahkamah Agung (MA) menolak gugatannya terhadap Philip Stein buatan lokal yang dimiliki oleh Kasim Halim.
 
Philip Stein merupakan jam tangan yang dibikin di 169 East Flagler Street, Miami, Florida. Merek Phlilip Stein sudah terdaftar di AS, Arab Saudi, Hong Kong, Argentina, Austria, Benelux, Brasil, Kanada, China, Kolombia, Kostarika, Mesir, Jerman, Italia, Jepang, Malaysia, Meksiko, Maroko dan Inggris. Belakangan, pihak Philip Stein kaget mendapati merek serupa yang beredar di Indonesia yang diproduksi Kasim Halim. Namun setelah dicek, ternyata Kasim Halim telah mengantongi sertifikat merek nomor IDM 000174089.
 
"Tergugat I sebagai WNI seharusnya menggunakan nama-nama merek yang jelas menampakkan identitas nasional Indonesia dan sejauh mungkin menghindari nama-nama merek yang mirip apalagi menjiplak nama merek asing," gugat Philip Stein yang tertuang dalam putusan kasasi sebagaimana dilansir website Mahkamah Agung (MA), Jumat (22/5/2015).
 
Hal itu sesuai dengan yurisprudensi MA putusan perkara nomor 220/PK/Perd/1986 tentang merek Nike. Menurut Philip Stein, jam tangan yang memiliki persamaan itu menimbulkan kondisi persaingan curang, mengecoh atau menyesatkan konsumen. Atas dasar itu, Philip Stein meminta Kemenkum HAM mencabut sertifikat merek yang dipegang Kasim Halim. 
 
Kemenkum HAM menjawab gugatan tersebut dengan menyebut bahwa gugatan Philip Stein telah kedaluwarsa. Menurut Dirjen HAKI, merek Kasim Halim telah dikantongi sejak 2 Agustus 2008 dan gugatan didaftarkan pada 13 September 2013.
 
"Sesuai dengan ketentuan pasal 69 ayat 1 UU Nomor 15 Tahun 2001 tentang merek, pengajuan gugatan Penggugat adalah sudah kedaluwarsa," ucap Kemenkum HAM dalam jawaban gugatan itu.
 
Tapi gugatan Philip Stein kandas. Pada 10 Desember 2013 majelis hakim Pengadilan Negeri Jakarta Pusat (PN Jakpus) menolak gugatan Philip Stein untuk seluruhnya. Tidak terima, Philip Stein lalu mengajukan kasasi. Apa kata MA?
 
"Ternyata merek yang dinyatakan penggugat tidak dapat dikualifikasikan sebagai merek terkenal karena hanya terdaftar di 4 negara, sedang di beberapa negara yang diajukan sebagai pembuktian, pendaftarannya belum mendapat pengesahan/belum dikeluarkan persetujuan dari pihak berwenang," kata majelis kasasi dalam pertimbangannya.
 
Duduk sebagai ketua majelis Djafni Djamal dengan anggota Mahdi Soroinda Nasution dan Nurul Elmiyah. Atas dasar itu, majelis menolak kasasi Philip Stein.
 
"Menghukum pemohon kasasi untuk membayar biaya perkara dalam tingkat kasasi sebesar Rp 5 juta," putus majelis dengan suara bulat pada 27 Agustus 2014 silam.
