Ichwan Anggawirya: Audisi Beasiswa Bulutangkis PB Djarum Tidak Mengeksploitasi Anak

Audisi pencarian bakat Bulutangkis yang dilakukan oleh Persatuan Bulutangkis (PB) Djarum sempat menjadi polemik karena adanya komentar yang menyatakan PB Djarum mengeksploitasi anak dengan UU No 35 Tahun 2014.
 
Praktisi dan pakar HAKI Magister Ilmu Hukum Universitas Bung Karno, Ichwan Anggawirya di forum grup diskusi senin dikampus Magister Ilmu Hukum Universitas Bung Karno, Senin (9/9/2019) mengatakan tidak ada korelasi antara logo yang digunakan pada kaos audisi beasiswa PB Djarum dengan logo Rokok Djarum.
 
Dikatakan oleh Ichwan, logo Djarum Foundation terdaftar dikelas 41 untuk jasa-jasa dibidang pendidikan dan kebudayaan, jasa sosial, jasa olah raga jadi tidak ada kaitan dengan logo Rokok Djarum jadi tidak ada yang salah dalam hal ini.
 
"Kata mengeksploitasi anak sebenarnya terlalu berlebihan kata Ichwan, tapi mungkin akan lebih tepat kalau mau dibilang sebagai komunikasi yang kurang pas. Sedangkan logo rokok djarum masuk dalam klasifikasi 34," ungkap Ichwan Anggawirya.
 
Sementara itu Ketua Alumni Magister Ilmu Hukum UBK, Ir Petrus Bramandaru SH, MH di acara yang sama mengatakan UU Nomor 35 Tahun 2019 adalah Undang-Undang Tentang Perubahan Atas Undang-Undang Nomor 23 Tahun 2002 Tentang Perlindungan Anak.
 
"Tidak pas bila dipakai sebagai dasar rujukan untuk menuduh PB Djarum dalam hal ini Persatuan Bulutangkis Djarum mengekploitasi anak, tidak nyambung," kata Bramandaru mengingat pada PP Nomor 109 Tahun 2012 pada pasal 36 ayat (1) mengatakan setiap orang yang memproduksi dan/ atau mengimpor produk tembakau yang mensponsori suatu kegiatan lembaga dan/atau perorangan hanya dapat dilakukan dengan ketentuan sebagai berikut:
a. tidak menggunakan nama merk dagang dan logo Produk Tembakau termasuk brand image Produk Tembakau; dan
b. tidak bertujuan untuk mempromosikan Produk Tembakau.
 
"Jadi antara merk serta logo Djarum Foundation dan merk serta logo Rokok Djarum berbeda sama sekali. Jangan asal menuduh PB Djarum mengeksploitasi anak berkaitan dengan kata Djarum yang tertera dikaos yang dipakai oleh anak-anak peserta audisi beasiswa Djarum Foundation. Kita tahu bersama Djarum Foundation telah menelorkan juara-juara bukutangkis serta mengharumkan Indonesia dikancah dunia olaraga bulutangkis.," papar Bramandaru.
