Sengketa Merek Mawar Super Laundry

Siti Wardah, pengusaha cairan pembersih untuk laundry pakaian mengajukan gugatan pembatalan merek 'MAWAR SUPER LAUNDRY'. Gugatan itu didaftarkan di Pengadilan Niaga Jakarta. "Klien saya ajukan gugatan pembatalan karena pendaftaran merek dilakukan dengan itikad tidak baik dan tidak jujur," kata kuasa hukum penggugat, Ichwan Anggawirya kepada Gatra.com di Jakarta, Sabtu, (23/6).
 
 
Siti Wardah yang akrab disapa Wardah sudah merintis usaha produksi cairan pembersih untuk laundry pakaian sejak 2013 silam. Merek produknya itu ia beri nama 'MAWAR SUPER LOUNDRY'. Wardah juga membuat sendiri logo untuk mereknya. "Saya yang mendesain dan menentukan jenis huruf serta komposisi warnanya," ujarnya.
 
Pada 2015, Rosa Sumaya yang awalnya menjadi pemasok botol kemasan, tertarik menjadi distributor cairan pembersih yang diproduksi Wardah. Kongsi bisnis disepakati. Bisnis berkembang pesat. Pada Januari 2017, Wardah berinisiatif mendaftarkan merek produk cairan pembersihnya, MAWAR SUPER LOUNDRY berikut logonya ke Direktorat Jenderal Hak Kekayaan Intelektual, Kemenkumham.
 
Namun, permohonan pendaftaran merek ditolak. Melalui surat tertanggal 26 Maret 2018, Ditjen HKI menyebut  pendaftaran ditolak karena  sudah lebih dulu  terdaftar merek MAWAR SUPER LAUNDRY  di Ditjen HKI atas nama Siti Hardita Sundari yang diajukan pada 28 September 2016.
 
Ichwan menjelaskan dari hasil penelusuran yang dilakukan tim kuasa hukum Wardah ditemukan fakta bahwa pendaftaran merek oleh Siti Hardita Sundari diduga  dilakukan dengan itikad tidak baik.  
 
Ternyata, pendaftar adalah saudara kandung dari Rosa Sumaya yang pernah menjadi distributor, dan kemudian secara diam-diam memproduksi dan memasarkan sendiri cairan pembersih dengan menggunakan merek MAWAR SUPER LAUNDRY.
 
Ichwan mengungkapkan bahwa pendaftaran merek di Indonesia memang menganut asas first to file. Artinya siapa yang mengajukan merek terlebih dahulu maka dianggap sebagai pemegang merek. Tapi sepanjang permohonan pendaftaran merek harus diajukan dengan itikad baik. “Faktanya, pendaftaran dilakukan dengan itikad tidak baik,” terangnya.
