Sengketa Merek, Pia Legong Kalahkan Pia Janger

Jakarta - Siapa yang tidak tahu Pia Legong? Bagi kebanyakan pelancong yang berwisata ke Bali, mereka mau antri berjam-jam untuk bisa merasakan kenikmatan Pia Legong. Tapi belakangan muncul merek serupa, Pia Janger. Sengketa pun bergulir ke pengadilan.
 
Merek Pia Legong ini dimiliki oleh Hantje yang mendaftarkan hak ciptanya ke Dirjen HAKI Kemenkum HAM pada Agustus 2008. Salah satu yang didaftarkan yaitu desain kotak kemasan Pia Legong. Kotak ini memiliki komposisi warna cokelat dengan klir dorp, terdapat tulisan Pia Legong dengan warna keemasan, terdapat penari Bali, pura dan 3 gambar kue pia. Untuk rasa, Hantje meracik sendiri resepnya dan memasarkan dengan menjualnya hanya di Ruko Kuta Megah, Jalan By Pass Ngurah Rai, Badung. Harga dibanderol Rp 70 ribuan per paket.
 
Sejak diluncurkan, Pia Legong langsung menggoda wisatawan. Setiap hari puluhan wisatawan membeli Pia Legong hingga Pia Legong menjadi terkenal dan salah satu paket oleh-oleh yang wajib dibeli wisatawan.
 
Belakangan, Hantje mulai terusik dengan adanya keluhan konsumen soal rasa pianya. Lalu Hantje menyelidiki dan ditemukan merek Pia Janger yang mirip dengan merek Pia Legong. Harganya lebih murah Rp 10 ribu dibanding dengan Pia Legong.
 
Kesamaan merek ini mengecoh konsumen sehingga brand Pia Legong yang telah dibangun dengan susah payah menjadi tercemar di mata wisatawan. Konsumen yang membeli Pia Janger kecewa karena rasanya tidak enak, tetapi yang kena keluhan Pia Legong. Merasa merugi, Hantje pun melayangkan gugatan ke Pengadilan Niaga Surabaya dengan mengguat pemilik Pia Janger yaitu Antonius dan Iriene. Hantje menggugat kedunya untuk menghentikan peredaran Pia Janger serta memberikan ganti rugi Rp 15,3 miliar.
 
Gayung bersambut. Pada 18 September 2013, Pengadilan Niaga Surabaya menyatakan Pia Legong sebagai pemilik desain yang sah sedangkan Pia Janger harus menarik penjualan dan membayar kerugian Hantje sebesar Rp 2 miliar. Tidak terima, Pia Janger lalu mengajukan kasasi. Majelis kasasi mengoreksi putusan dengan menghapus hukuman ganti rugi tersebut.
 
"Menyatakan Tergugat I dan Tergugat II secara bersama-sama telak melakukan pelanggaran hak desain industri atas kemasan kotak milik penggugat. Menghukum tergugat I dan Tergugat II selambat-lambatnya dalam waktu 7 hari setelah putusan ini diucapkan untuk menghentikan pembuatan, peredaran, penjualan, perdagangan dengan kotak kemasan identik dan mirip milik Penggugat. Menarik dari peredaran semua produk Pia Janger dengan kotak kemasan identik mirip milik Penggugat," putus majelis sebagaimana dilansir website Mahkamah Agung (MA), Jumat (6/2/2015).
 
Duduk sebagai ketua majelis Djafni Djamal dengan anggota Nurul elmiyah dan Mahdi Soroinda Nasution. "Menolak gugatan untuk selebihnya," putus majelis pada 25 Juli 2014 lalu.
