Berebut Ayam Lepaas Di Mahkamah Agung

Jakarta - Anda pernah merasakan enaknya ayam goreng di gerai warung Ayam Lepaas? Siapa nyana, gerai yang pernah mendapat penghargaan Franchise Award 2012 itu menyimpan sengketa perebutan merek hingga bermuara ke pengadilan, bahkan hingga Mahkamah Agung (MA).

Kasus bermula saat Ahmad Syaiful Bachri berkenalan dengan Suparno di Aceh pada 2009. Saat itu Suparno yang juga memiliki bisnis ayam penyet sedang mengalami kerugian. Atas masalah itu, Ahmad Syaiful Bachri memberikan bantuan Rp 50 juta dan binis ayam penyet itu kembali bisa bernafas. Lalu keduanya sepakat membangun bisnis warung ayam penyet dan sebagai tanda rebranding, mereka memberi nama warungnya Ayam Lepaas. Launching gerai pertama bertempat di Lampriet, Aceh pada 2009.

Setahun kemudian, Ahmad Syaiful Bachri membuka gerai Ayam Lepaas di Malang. Delapan bulan setelahnya, Ahmad Syaiful Bachri berkongsi dengan Ade Mukhtar membuka gerai Ayam Lepaas di 9Walk, Bintaro. Lantas disusul dengan membuka gerai Ayam Lepaas di 5 tempat di Aceh.

Setelah bisnisnya mapan, Ayam Lepaas mulai menggoyang lidah warga Jakarta pada 2011 yaitu dengan membuka gerai di Kalimalang, Rawamangun, Kelapa Gading, Cililitan, Pondok Gede dan Cakung. Selain itu masyarakat di sekitar Jakarta juga bisa mencicipi Ayam Lepaas di Kranji, Bintaro Utara dan Cimanggu.

Dengan besarnya nama Ayam Lepaaas maka Suparno dan Ahmad Syaiful Bachri membuat PT Rozzo Dewe Jayakarta pada Maret 2011. Bisnis Ayam Lepaas semakin besar dengan membuka gerai di Palembang dan Malang untuk gerai kedua kalinya. Memasuki tahun 2012, Ayam Lepaas semakin memanjakan lidah masyarakat dengan gerai-gerai baru yang dibuka di berbagai tempat seperti di Surabaya sebanyak 3 titik dan di Jalan Kisamaun Tangerang.

Belakangan konflik muncul. Suparno mendaftarkan merek Ayam Lepaas ke Dirjen HKI pada 2013 secara sepihak tanpa diikutsertakannya Syaiful. Atas hal itu, Syaiful menggugat rekan bisnisnya itu ke Pengadilan Niaga Medan. Gayung bersambut yaitu pada 17 Juli 2013, majelis hakim memerintahkan Dirjen HKI mencabut merek Ayam Lepaas dari daftar sebagaiamana yang didaftarkan Suparno.

Atas hal itu, Suparno tidak terima dan mengajukan kasasi. Apa kata MA?

"Menolak permohonan kasasi Suparno. Menyatakan tergugat adalah pemohon yang beritikad tidak baik. Membatalkan tergugat pendaftaran merek Ayam Lepaas," putus majelis kasasi sebagaiaman dilansir website MA, Minggu (9/11/2014).

Duduk sebagai ketua majelis Vallerina JL Kriekhoff dengan anggota Abdurrahman dan Sultoni Mohdally. Menurut ketiga hakim agung itu, pendaftaran merek tanpa sepengetahuan Ahmad Syaiful Bachri, padahal Ahmad Syaiful Bachri adalah teman bisnis Suparno yang merintis dan bekerjasama mendirikan warung makan Ayam Lepaas sejak awal, namun akhirnya Suparno meninggalkan Ahmad Syaiful Bachri.

"Menghukum pemohon kasasi/tergugat untuk membayar biaya perkara dalam tingkat kasasi sebesar Rp 5 juta," putus majelis pada 29 Januari lalu.

"Menolak permohonan kasasi Suparno. Menyatakan tergugat adalah pemohon yang beritikad tidak baik. Membatalkan tergugat pendaftaran merek Ayam Lepaas," putus majelis kasasi sebagaiaman dilansir website MA, Minggu (9/11/2014).
