Emanuel Ungaro Terlilit Sengketa Merek

Desainer terkemuka, Emanuel Ungaro terlilit sengketa merek dengan Komisi Banding Merek Indonesia. Perselisihan timbul sebagai akibat putusan Komisi Banding yang mementahkan pendaftaran merek ‘Ungaro Fever’ milik pria kelahiran Italia itu. Pendaftaran itu ditujukan untuk melindungi nama dagang pada produk pakaian remaja dan dewasa. Sayangnya, pendaftaran merek Ungaro Fever terganjal merek Fever. Walhasil, pendaftaran yang digagas sejak Desember 2003 hingga kini belum menuai hasil.
 
Semula, Direktorat Merek Ditjen Hak Kekayaan Intelektual (HKI) yang pertama kali menolak pendaftaran merek Ungaro Fever. Surat penolakan Direktorat Merek itu terbit setelah hampir lima tahun pendaftaran diajukan, tepatnya 30 April 2008. Direktorat pimpinan Andi Noorsaman Someng itu beralasan merek Ungaro Fever memiliki persaman pada pokoknya dengan merek terdaftar Fever No. IDM00001164.
 
Tiga bulan kemudian, tepatnya pada 29 Juli 2008, Emanuel mengajukan banding ke Komisi Banding Merek. Namun lagi-lagi ditolak dengan alasan yang sama. Putusan Komisi No. 190/KBM/HKI/2008 dijatuhkan pada 12 Februari 2009.
 
Penolakan itu membuat Emanuel kecewa. Bagaimana tidak, merek Ungaro Fever sudah dikenal di dunia. Emanuel sendiri memulai karir di dunia fashion sejak 1973. Ketika itu, ia pertama kali mengeluarkan koleksi pakaian pria bermerek Ungaro Uomo. Ia juga mengeluarkan produk wewangian bermerek Diva sepuluh tahun sesudahnya. Setelah itu, ia mengeluarkan parfum bermerek Senso (1987), Ungaro (1991) and Emanuel Ungaro For Men (1991).
 
Merek Ungaro Fever sendiri diambil dari nama badan hukum alias perusahaan milik Emanuel. Dengan begitu seharusnya Direktorat Merek memberikan perlindungan sesuai Pasal 6 ayat (3) UU Merek. Bahkan, Mahkamah Agung (MA) mengakui Ungaro sebagai merek terkenal asa luar negeri dan ada kaitannya dengan nama desainer terkenal Emanuel Ungaro. Hal itu dituangkan dalam putusan MA No. 801 K/Pdt/1988 tanggal 30 Juni 1993.
 
Emanuel melalui kuasa hukumnya, akhirnya mengajukan gugatan ke Pengadilan Niaga Jakarta Pusat untuk melawan putusan Komisi Banding. Gugatan teregister dalam perkara No. 09/Merek/2010/PN.JKT.PST. Majelis hakim yang diketuai Syarifuddin telah dua kali menggelar persidangan perkara ini. Persidangan kedua digelar, Kamis (18/2) dengan agenda penyerahan jawaban dari Komisi Banding.
 
Dalam gugatan, kuasa hukum menyatakan penolakan Komisi Banding Merek tidak beralasan. Sebab, putusan komisi banding dinilai tak sesuai dengan Pasal 6 UU Merek dan yurisprudensi MA tersebut. 
 
Dalam putusannya, Komisi Banding menimbang berdasarkan konseptual dan persamaan unsur kata yang dominan pada merek Ungaro Fever dan Fever. Padahal, menurut kuasa hukum Emanuel, merek penggugat terdiri dari dua unsur kata. Merek itu diucapkan Ungaro Fever yang secara visual maupun tulisannya tidak ada unsur yang dominan dengan merek Fever.
 
Menurut hukum dan yurisprudensi penilaian ada tidaknya penilaian ada tidaknya persamaan pada pokoknya harus dilihat dari kesan total secara keseluruhan bukan dengan membanding-bandingkan bagian yang sama. Dengan begitu, yang seharusnya dibandingkan adalah unsur dominan dari merek Emanuel, yakni kata pertama Ungaro. Kata, Ungaro tidak akan memberikan kesan keliru bagi khalayak ramai dengan adanya merek terdaftar Fever. Sebab Ungaro Fever merupakan merek terkenal.
 
Karena itu, Emanuel meminta majelis hakim agar mengabulkan gugatan dan menyatakan putusan komisi banding tidak beralasan menurut hukum. Emanuel juga meminta majelis hakim memerintahkan Dirjen HKI untuk melaksanakan pengumuman dalam berita resmi merek atas permintaan pendaftaran merek Ungaro Fever.
 
Menyesatkan Konsumen
Kuasa hukum Komisi Banding tetap berpendapat bahwa eksitensi merek Ungaro Fever dan merek Fever bersamaan bisa menyesatkan konsumen. Apalagi produk kedua merek merupakan barang sejenis. Karena itu penolakan pendaftaran merek Ungaro Fever sudah sesuai dengan aturan hukum di bidang merek
 
Menurut kuasa hukum Komisi Banding, unsur merek Fever dalam etiket merek Ungaro Fever adalah juga tanda yang dikualifikasi sebagai merek dalam permintaan pendaftaran merek. Dengan begitu, kata Fever harus turut menjadi elemen yang diperiksa dalam pemeriksaan sunstantif. Apalagi merek Fever terdaftar di Daftar Umum Merek.
 
Apabila elemen kata Fever bukan merupakan suatu tanda yang dikualifikasi sebagai merek, kenapa secara hukum penggugat mencantumkan kata tersebut dalam etiket merek permintaan pendaftaran merek. Pencantuman itu menunjukan penggugat menginginkan kata Fever dilindungi secara hukum. Karena itu patut dipertimbangkan, kesimpulannya, penolakan Komisi Banding justru sesuai dengan Pasal 6 ayat 1 UU Merek.
