Sarung Tinju Everlast Sungkurkan Merek Bandung

Anda pernah memperhatikan sarung tinju yang digunakan petinju kelas dunia seperti Mike Tyson dkk? Di sarung tinju tersebut tertulis Everlast, yaitu merek sarung tinju tersebut. Tapi hati-hati, ada yang palsu di pasaran.
 
Merek Everlast dipromosikan oleh petinju-petinju legendaris bertaraf internasional seperti Muhammad Ali, Mike Tyson, Evander Holyfield dan George Foreman. Selain di Indonesia, Everlast juga terdaftar di berbagai belahan dunia lain seperti di AS, negara-negara Benelux, Panama, Portugal, India, Lebanon, Honduras, Singapura dan Guatemala.
 
Di Indonesia terdaftar di Ditjen Haki dengan nomor merek IDM00120922 tertanggal 11 Mei 2007, IDM000176005 tertanggal 10 September 2008 dan IDM00265078 tertanggal 5 Oktober 2009.
 
Meski telah mengantongi sertifikat merek, tetapi beredar barang dengan merek yang menyerupai persamaan pada pokoknya, yaitu 'Ever Last' buatan Bandung. Atas hal ini, Everlast merasa khawatir konsumen terkecoh sehingga berimbas kepada produsen Everlast. Produsen Everlast asli, Everlast World's Boxing Headquarters Corporation pun menggugat pengusaha lokas asal Bandung, Tedy Tjahyadi. 
 
Namun gugatan ini ditolak oleh Pengadilan Negeri Jakarta Pusat (PN Jakpus) pada 12 April 2012. Mendapat 'pukulan' telak tersebut, perusahaan yang beralamat di 1350 Broadway, New York, AS ini mengajukan kasasi dan dikabulkan.
 
Majelis kasasi yang terdiri dari I Made Tara, Soltoni Mohdally dan Prof Syamsul Ma'arif PhD Mengabulkan gugatan Penggugat untuk seluruhnya. Ketiganya menyatakan penggugat sebagai pemilik dan pendaftar pertama atas merek dagang Everlast di Indonesia maupun di dunia internasional. Oleh karenanya mempunyai hak tunggal untuk memakai merek dagang Everlast.
 
MA menilai pengusaha lokal mendompleng ketenaran merek milik Everlast. Dalam putusan yang diketok pada 17 September 2012 lalu ini, MA memerintahkan Kementerian Hukum dan HAM mencabut sertifikat merek Ever Last.
