Sengketa Jam Tangan Mewah Piaget

MA mengabulkan permohonan Richemont International S.A yang menggugat pengusaha lokal Hartafadjaja Mulia. Perusahaan yang berpusat di Swiss ini menggugat jam tangan buatan Hartafadjaja yang mereknya serupa, Piaget.
 
Richemont merupakan perusahaan yang bermarkas di Route des Biches 10, Geneva, Swiss. Salah satu anak perusahaannya adala Piaget SA yang membuat jam dan perhiasan mewah. Menurut studi peringkat perhiasan The Luxury Institute, Piaget masuk sebagai merek perhiasan ke 6 paling bergengsi di dunia.
 
Richemont kaget ternyata ada jam tangan serupa yang beredar di Indonesia. Alhasil, perusahaan yang didirikan pada 1874 oleh Georges Piaget di desa La Cte-aux-Fes ini pun melayangkan gugatan ke Pengadilan Negeri Jakarta Pusat (PN Jakpus).
 
Siapa nyana, gugatan salah satu orang terkaya di Swiss itu dimentahkan PN Jakpus pada 16 Agustus 2012 dan mengadili tidak menerima (niet ontvankelijk verklaard).
 
Gugatan dianggap telah melewati batas waktu pengajuan 5 tahun untuk pembatalan merek sebagaimana ketentuan Pasal 69 ayat (1) UU No 15/2001 tentang Merek. Gugatan bisa dilakukan tanpa batas waktu jika merek penggugat itu adalah merek terkenal.
 
PN Jakpus menilai klaim sebagai merek terkenal tidak dapat dibuktikan di pengadilan niaga sehingga Richemont dianggap tak memiliki legal standing untuk membatalkan merek Piaget Polo versi Hartafadjaja.
 
Tidak terima, lalu Richemont pun mengajukan perlawanan hukum kasasi dan dikabulkan. MA menyatakan kedaluwarsa merek tidak ada batas waktu apabila yang bersangkutan bertentangan dengan moralitas, agama, kesusilaan dan ketertiban umum.
 
"Berdasarkan itikad tidak baik termasuk pengertian bertentangan dengan kesusilaan atau ketertiban umum," demikian alasan majelis kasasi yang diketuai oleh I Made Tara dengan anggota Soltoni Mohdally dan Djafni Djamal.
