Rebutan Merek Neo Mild Naik Kasasi

SURABAYA – Sengketa saling mengklaim merek rokok Neo Mild, belum juga berakhir. PT Bintang Pesona Jagat (PT BPJ) yang mengklaim sebagai produsen rokok merek Neo Mild menyatakan akan melakukan kasasi ke Mahkamah Agung (MA), usai dinyatakan kalah dalam persidangan niaga melawan PT Karya Tajinan Prima (PT KTP).

"Pada hari ini, klien kami mengajukan permohonan kasasi kepada Pengadilan Niaga Surabaya atas putusan gugatan pelanggaran merek yang dibacakan pada tanggal 25 Mei 2011 yang lalu," kata kuasa hukum PT BPJ, Parmagita Moerad, dalam rilisnya, Senin (13/6/2011).

Gita mengatakan bahwa kasus sengketa merk PT BPJ merupakan kasus pelanggaran merek yang pertama yang diajukan ke Mahkamah Agung (MA). Berdasarkan UU No. 15 tahun 2001 tentang merek, peranan merek menjadi sangat penting, terutama dalam menjaga usaha persaingan yang sehat.

"Karena itu, PT BPJ sejak 17 Mei 2001 sudah mendaftarkan merk Neo Mild ke Ditjen HaKI dan memperoleh sertifikat merek 503266," tambah Parmagita.

Setelah Neo Mild diproduksi dan dipasarkan, pihak PT BPJ menemukan jika distribusi Neo Mild di Surabaya dan Jatim tersendat. Setelah diusut, diketahui jika ada rokok lain yang mempunyai nama sama. Rokok itu adalah Neo yang diproduksi PT Karya Tajinan Prima (KTP). Rokok merek Neo bahkan diketahui tidak terdaftar di Ditjen HaKI.

Pada 7 Maret 2011, PT BPJ melakukan gugatan terhadap PT KTP ke pengadilan niaga Surabaya terkait penggunaan merek dan pengucapan merek yang sama. Dalam persidangan terungkap jika rokok merek Neo memang tidak terdaftar di Ditjen HaKI tetapi mengantongi penetapan pita cukai rokok untuk pemasarannya. Berdasarkan hal itulah majelis hakim menolak gugatan PT BPJ.**
