Orang Terkaya di Dunia Kalah, Merek IKEA Dimiliki Pengusaha Surabaya

Mahkamah Agung (MA) menolak kasasi IKEA dan menguatkan putusan Pengadilan Negeri Jakarta Pusat (PN Jakpus). Alhasil, merek IKEA kelas 20 dan 21 dimiliki oleh perusahaan asal Surabaya, PT Ratania Khatulistiwa. 
 
Berdasarkan website Mahkamah Agung (MA) yang dikutip detikcom, Minggu (9/8/2015), kasus bermula saat PT Ratania Khatulistiwa menggugat IKEA ke PN Jakpus dan meminta merek IKEA dihapus. Gayung bersambut. PN Jakpus mengabulkan permohonan PT Ratania Khatulistiwa.
 
"Dalam pokok perkara, mengabulkan gugatan Penggugat," putus majelis PN Jakpus yang diadili oleh ketua majelis hakim Lidya Sasando Parapat dengan anggota majelis Robert Siahaan dan Rochmad.
 
Vonis yang diketok pada 17 September 2014 menyatakan penghapusan pendaftaran merek IKEA atas nama Tergugat dengan Nomor Pendaftaran IDM000277901 tanggal pendaftaran 27 Oktober 2010 untuk kelas barang 20 dari Daftar Umum Merek Direktorat Jenderal HAKI dengan segala akibat hukumnya. Majelis PN Jakpus juga menghapus merek IKEA untuk kelas barang 21.
 
Kelas barang 20 adalah barang antara lain perabot rumah, cermin, bingkai gambar, benda dan lainnya. Adapun kelas 21 adalah barang antara lain perkakas atau wadah untuk rumah tangga, sikat dan sebagainya.
 
Tidak terima dengan putusan ini, IKEA lalu mengajukan kasasi. Tapi apa kata MA?
 
"Menolak permohonan kasasi Inter IKEA System BV," ucap majelis hakim yang diketuai Syamsul Maarif. Dalam putusan yang diketok pada 12 Mei 2015 ini, duduk sebagai hakim anggota yaitu Abdurrahman dan I Gusti Agung Sumanatha.
 
Lantas, siapakah IKEA itu? IKEA merupakan akronim dari 4 kata yaitu Ingvar, Kamprad, Elmatayd dan Agunnaryd dan disingkat IKEA. Produknya tersebar di berbagai negara seperti Canada, Jerman, Israel, Swiss, Singapura, Swedia, Portugal, India, Malaysia, Mesir, Inggris, Afrika Selatan, Perancis, Jepang, Selandia Baru dan Indonesia. Atas keberhasilannya membangun kerajaan bisnis, Ingvar masuk sebagai salah satu orang terkaya di dunia. Sejajar dengan Bill Gates, Warren Buffet dan Li Ka-Shing.
 
Di Indonesia, IKEA telah membuka gerainya yang sangat luas di Alam Sutera, Tangerang, Banten. Adapun PT Ratania Khatulistiwa, berdasarkan websitenya, www.ratania.com, perusahaan itu beralamat di Jalan Greges 17A, Kecamatan Aserowo, Surabaya.
